Wrongful Death Case Settles for $900,000

Attorney Domingo Garcia’s client needlessly died while employed by Texas Sprinklers, based out of Plano, Texas. The client had been working at a commercial warehouse where an electrical sub-contractor, Riggins-Moreland Engineering, was digging holes. This contractor failed to place any warning around the hole, or attempt to cover the hole in any way.

On this particular site, our client Ramon Gonzalez was operating a scissor lift in the warehouse when the front driver’s side wheel fell in a 2’x2’ hole. This caused the lift to fall on the driver’s side and impact a wall brace that was set up. Ramon’s head impacted the concrete, causing a fatal injury while his co-workers watched unable to do help. Ramon was killed needlessly as a result of the gross negligence of the defendants.

This wrongful death was caused by the gross negligence, intentional misconduct and/or omission of Defendants. Defendants actions constituted an omission in that they failed to properly train their employees on how to operate the scissor lifts safely so as to prevent harmful acts to be caused against other employees or the public at large. We argued the defendants are liable for their tortuous omissions in that they failed to cover up the 2’x2’ hole in the ground as to prevent the employees operating the scissor lift from falling into the hole.

Attorney Garcia was successful in helping this family settle their case for $900,000. After all medical expenses, bills and attorney fees were paid, the family received a check for $451,931. While no amount of money can bring back a loved one we believe lawsuits are important in making sure companies have to make actual changes to their practices.
